CCPA & GDPR & Privacy Policy

CCPA

1. What is CCPA:

In simple language, the new California, USA law requires that all publishers (You) provide California residents the option to ‘opt-out’ of selling their data from your web site(s). The easiest way to do this is by providing a standardized ‘opt-out’ tool that informs and asks the consumer if they would like to ‘opt-out’. Once the consumer does opt-out, the ‘opt-out’ tool will inform 3rd parties like Infolinks of this so we can inform everyone we communicate with. 2. What is Considered CCPA ‘Consumers Data’ ?

CCPA defines personal information as information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household such as a Internet Protocol address, real name, alias, postal address, unique personal identifier, online identifier, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.

3. How Does CCPA Affect Publishers

Advertisers and many vendors on your web site (plugins, etc.) potentially use personal information as defined by the CCPA law to target or service consumers and that data can be found on your site when an ad is shown. This could be considered a sale of data if you do not provide the consumer with the ability to opt-out from data sales. It also could impact advertising or other income in the state of California if the opt-out isn’t provided.

4. How do I Comply with CCPA

A simple solution is to immediately begin using a FREE standardized data ‘Opt Out’ solution such as provided by CookiePro (https://www.cookiepro.com/ccpa-opt-out/) to be in compliance. Infolinks is CCPA compliant with the IAB Compliance Framework and will capture the opt-out and communicate with all IAB compliant tools.

GDPR & Privacy Policy

As you know, the European Union’s General Data Protection Regulation (GDPR) 2016/679 (“GDPR”) went into effect on May 25, 2018. The GDPR broadly applies to all companies that process personal data from citizens of the European Union (EU) and affects virtually all companies in the digital publishing and advertising ecosystem.

We deeply value our Publisher relationships and recognize the extensive challenge GDPR places on you and we are here to help and be a solution. To ensure we are mutually compliant and you can continue to grow your advertising earnings with Infolinks Media, we have pursued a Publisher focused strategy. Please read everything to ensure you are informed.

It is very important you are informed and are in compliance with our respective GDPR obligations, including updates to the privacy and data collection policies. Since the GDPR requirements apply separately to each entity involved in personal data collection and processing, we will each be individually and independently responsible for complying with our own obligations under the GDPR. This notice will define the respective obligations between our companies under our commercial relationship going forward:

Consent. The GDPR will update the level of consent required to collect and use personal data.  Specifically, the GDPR requires freely given, specific, informed and unambiguous indication of the data subject’s wishes.  For a full description of requirements under GDPR please see the EU’s rules for business and organizations. As a trusted partner of Infolinks, you are responsible for determining the lawful basis for processing personal data that falls under the GDPR, and obtaining all necessary end user consent as necessary to meet the legal requirements for processing personal data and the use of cookies or other web beacon technology in connection with the use of our services.

IAB Framework & Consent Signals. You may consider registering as a Global Vendor through the IAB Europe Transparency & Consent Framework so that you can take advantage of standardized user consent capture and signals sent through Consent Management Providers (CMPs) based on the Framework.

Privacy Policy and Data Processing. We have recently updated our Privacy Policy in order to clarify our terms on the collection, use and disclosure of your personal data to third parties. Please read the entire policy for more information. By continuing to use our services, you agree to comply with the DPA and applicable legal requirements.

Publisher Solution. While you work towards individual compliance, Infolinks Media recognizes that many publishers will not be fully compliant and we are committed to providing a solution to ensure you can continue to work with Infolinks in EEA countries. To comply with the GDPR regulations we have converted all advertising targeting in the EEA to NON Personally Identifiable Information (PII) contextual only targeting. We have made significant technological adjustments to prohibit advertisers from collecting or targeting PII in the EEA and we will continue to provide non-audience specific contextual only targeting. We recognize that gaining ‘consent’ is challenging so at this time, the Infolinks ad systems will default to user consent NOT being granted in the EEA. This will ensure all our advertising and publishing partners are compliant with Infolinks and can continue to offer Infolinks to all audiences.

Ads.txt Update. To further enhance your advertising revenue we strongly recommend you update our Ads.txt IDs to your site. Please login to your account to receive the latest Ads.txt IDs.

In the near future, we will be providing a simple ‘Consent’ transfer solution that will enable you to update Infolinks Media if you have received appropriate user consent on your site so that we can provide PII targeted advertising. We will update you of that solution shortly.

In conclusion, we are pleased to ensure Infolinks Media is compliant and you can continue to enjoy our ad products and earn income. If you have any questions please email: support@infolinks.com
